* How quickly can I get my divorce?
Your will receive your divorce judgment in 5 to 23 days.

I. BILATERAL DIVORCE
If your spouse consents to the divorce and signs a waiver, the judge will sign your divorce judgment within 4 business days. It takes a couple more business days for our attorney colleague in Haiti to obtain the certification from the American embassy. He or she will then express mail the judgment to us via DHL or another express courier.

II. UNILATERAL DIVORCE
If your spouse does not consent to the divorce, the judge will sign your divorce judgment in about 17 to 20 days after your court appearance. After a couple of days for the certification from the American embassy, our attorney colleague will then express mail the judgment to us via DHL or another express courier. You will then receive your divorce papers in 1 to 4 days later via express courier, depending on where you live.

Note: Although the Haitian court routinely grants unilateral divorces, we encourage our clients, whenever possible, to focus on getting a bilateral divorce. The reason is simple: The unilateral divorce is considered void by many jurisdictions. Read more.

The bilateral divorce is universally recognized. The unilateral divorce, on the other hand, is considered void in many jurisdictions. Although the Haitian court routinely grants unilateral divorces, we encourage our clients to read our caution on unilateral divorces.

* What if my spouse does not consent?
You can still get your divorce. Contrary to divorce laws in the Dominican republic, Haiti does not require the consent of your spouse. Read why many clients prefer Haiti.

* What is a unilateral and a bilateral divorce?
I. UNILATERAL DIVORCE
The unilateral divorce is by far the most common type of foreign divorce. In the unilateral divorce, only one spouse (the plaintiff spouse) petitions for the divorce and makes the court appearance. Whether the defendant spouse agrees or not is of no relevance.

II. BILATERAL DIVORCE
The bilateral divorce is less common. In a bilateral divorce both spouses agree to the divorce.

What is good about Haiti is that the consent of the defendant spouse is of no consequence. That is why ninety-five percent of the divorces we get are unilateral.

* How much is it going to cost me?
The total charge for our service is $2795 for the unilateral divorce and $3295 for the bilateral divorce. This fee covers:

(a) all legal fees
(b) court fees
(c) Ministry of Justice fees
(d) American Embassy certification
(e) translations and
(f) private local transportation

You will be represented in court by one of the top local attorneys who will accompany you from your hotel to the court and take you back to the hotel after your appearance.

* Do I have to travel?
One party (the plaintiff) is generally required to travel for one day. Our clients usually choose to leave on Sunday, make the short court appearance the next day (Monday) and return home that same afternoon.

Caution: Beware of sites and individuals that promise to get you a divorce without any travel. Any divorce obtained without traveling is invalid.

* Do you recommend any air carriers?
Try American Airlines (AA). AA flies to Port-au-Prince (PAP), Haiti from JFK Airport in New York and from Miami, Florida. We recommend that you use the services of a travel agent. You can also visit AA's website.

* Do I make any hotel reservation?
No. If you are staying overnight in Haiti, our attorney colleague will take you to a hotel. Expect to pay between $68 and $104 for the night.

Note: If your flight arrives in Haiti early enough (before 11:00 AM) on a weekday, you do not have to stay overnight. You can make the short court appearance and the appearance at the Ministry of Justice that same morning and fly back home in the afternoon. In such a case, try to schedule your return flight for anytime after 2:30 PM.

* Who will pick me up at the airport?
Our attorney colleague will pick you up personally at the airport. He or she will be holding a small sign with your name on it. You will be in good hands. Trust us.

* What about custody, visitation and property distribution?
If both parties have a settlement agreement, it can be incorporated in the divorce judgment. As for unilateral divorces, the Haitian court generally will not settle issues related to custody, visitation and property distribution. Therefore, for a unilateral divorce, your local court may still retain jurisdiction over custody, visitation and property distribution if one of the parties seeks judicial intervention.
